Colorado Hunt Genius Terms of Service

By clicking "Sign Up," "Create Account," "I Agree," or by accessing or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not access or use the Service.

These Terms constitute a legally binding agreement between you and Colorado Hunt Genius LLC.

You must be at least 18 years old to access or use the Service.

By creating an account or otherwise using the Service, you represent and warrant that you are at least 18 years of age.

The Service is not directed to, marketed to, or intended for use by individuals under the age of 18. If we learn, or have reason to believe, that an account has been created by, or is being used by, an individual under the age of 18, we may suspend or terminate that account and delete the associated information, without liability to us.

You are responsible for ensuring that your use of the Service complies with all applicable federal, state, and local laws and regulations.

Colorado Hunt Genius is an independent hunting research and planning platform designed to help hunters evaluate Colorado hunting opportunities.

The Service may provide tools and information including, but not limited to:

• Interactive hunt filtering
• Interactive maps
• Hunt code information
• Draw odds
• Historical draw statistics
• Land ownership insights
• Public land percentages
• Public land acreage
• Terrain analysis
• Elevation statistics
• Trophy potential estimates
• Wildlife population density estimates
• Male-to-female ratios
• Hunt comparisons
• Season information
• Hunt quotas
• Success rates
• Recreation statistics
• Saved preference points
• Favorite hunt lists
• Other planning and research tools

Some information displayed by the Service originates from publicly available information published by Colorado Parks and Wildlife ("CPW").

Other information—including but not limited to our databases, compilations, analytics, calculations, terrain metrics, classifications, rankings, maps, estimates, visualizations, filtering systems, and other derived data—is proprietary to Colorado Hunt Genius LLC.

Colorado Hunt Genius is not affiliated with, endorsed by, sponsored by, approved by, or acting on behalf of Colorado Parks and Wildlife or the State of Colorado.

You are responsible for:

• maintaining accurate account information;
• protecting the confidentiality of your password;
• maintaining the security of your account;
• all activity occurring under your account.

You must notify us promptly if you believe your account has been compromised or accessed without authorization.

You may not:

• impersonate another individual;
• create fraudulent accounts;
• provide false registration information;
• share your account credentials;
• allow another person to use your account;
• permit multiple users to access a single paid subscription.

We reserve the right to suspend or terminate accounts that reasonably appear to be shared among multiple users or otherwise violate these Terms.

Colorado Hunt Genius offers both Free and Pro accounts.

Free accounts provide limited functionality.

Pro subscriptions provide additional premium features, including but not limited to:

• Advanced hunt filters
• Multi-year historical draw odds
• Enhanced land information
• Proprietary analytics
• Additional research tools
• Future premium functionality

Features included within either subscription tier may change over time.

We reserve the right to add, modify, replace, discontinue, or remove features at any time.

Paid subscriptions are processed securely through Stripe.

Colorado Hunt Genius does not receive or store your complete payment card information.

Before you complete a purchase, we will clearly and conspicuously disclose the subscription price, the billing frequency (e.g., monthly or annual), and the fact that the subscription automatically renews, at the point of purchase.

Subscriptions automatically renew at the end of each billing period at the then-current subscription price unless canceled before the next renewal date.

By purchasing a subscription, you authorize Stripe to charge your selected payment method for recurring subscription fees, applicable taxes, and any other authorized charges associated with your subscription.

Unless otherwise stated, subscription prices do not include applicable sales, use, value-added, or similar taxes.

We will send you an email reminder in advance of each renewal charge for annual subscriptions.

Subscription pricing may change in the future. Any pricing changes will apply only to future renewal periods, and we will provide notice of any price increase at least seven (7) days before it takes effect, giving you the opportunity to cancel before being charged the new price.

You may cancel your subscription at any time through your account settings, using an online cancellation process that is no more difficult or time-consuming than the process you used to sign up. You are not required to call, email, or otherwise contact customer support to cancel, although you are welcome to do so.

Cancellation prevents future renewal but does not automatically entitle you to a refund for the current billing period.

Refund requests are considered on a case-by-case basis.

Refunds may be granted for circumstances including:

• accidental purchases;
• duplicate charges;
• billing errors;
• a verified technical issue that materially prevented access to the Service;
• other situations that Colorado Hunt Genius determines warrant a refund.

Refunds generally will not be issued because:

• you did not draw a hunting license;
• you changed your mind;
• your hunting plans changed;
• you found another hunt;
• you disagree with our analysis;
• you relied upon information that later changed;
• hunting statistics changed;
• hunting regulations changed.

Colorado Hunt Genius is intended to be a planning and research tool.

Although we strive to provide accurate, complete, and current information, we cannot guarantee that every piece of information is accurate, complete, current, or free from errors.

Mistakes, omissions, calculation errors, software bugs, typographical errors, data processing errors, delays in updates, and other inaccuracies may occur.

Additionally, hunting regulations, season dates, quotas, draw results, hunt codes, wildlife population information, public access information, land ownership information, and other hunting-related information may change at any time due to actions by Colorado Parks and Wildlife or other governmental entities.

You acknowledge that some information displayed by the Service originates from publicly available CPW information while other information—including calculations, analytics, rankings, classifications, terrain metrics, maps, estimates, and derived data—is independently created by Colorado Hunt Genius. Both official-source information and proprietary information may contain errors or become outdated.

You are solely responsible for independently verifying all hunting information through official Colorado Parks and Wildlife publications before:

• applying for a hunting license;
• purchasing a hunting license;
• relying upon draw odds;
• relying upon hunt quotas;
• making travel plans;
• participating in any hunt;
• making any hunting or licensing decision.

Your use of the Service is entirely at your own risk.

To the fullest extent permitted by applicable law, Colorado Hunt Genius LLC disclaims liability for losses or damages arising from inaccurate, incomplete, delayed, outdated, or erroneous information contained within the Service.

The Service categorizes and displays information regarding licenses that may be available through Colorado landowner vouchers.

Colorado Hunt Genius LLC is strictly an informational planning platform.

We do not:

• sell landowner vouchers;
• broker landowner vouchers;
• negotiate transactions;
• verify voucher availability;
• verify pricing;
• guarantee legality of any transaction;
• facilitate transfers between buyers and sellers.

Any transaction involving a landowner voucher exists solely between you and the applicable landowner or authorized broker.

Colorado Hunt Genius makes no representations or warranties regarding the legality, availability, pricing, authenticity, or validity of any landowner voucher.

The interactive maps, public land percentages, public land acreage, land ownership information, and boundary data provided through the Service are intended solely for general planning and informational purposes.

The Service relies on third-party mapping providers and publicly available geographic datasets, including but not limited to OpenFreeMap and MapLibre GL, which may contain inaccuracies, omissions, delays, or mapping errors.

You acknowledge and agree that:

• Property lines and public/private land boundaries displayed by the Service are approximate.
• The Service should not be relied upon for precise navigation or determining exact legal property boundaries.
• You are solely responsible for knowing your exact location while hunting.
• You must obey all posted signs, fences, gates, closures, and applicable laws regarding land ownership and access.
• You must independently verify land ownership and legal access before entering any property.
• The Service is not a substitute for official land ownership records, survey data, or on-the-ground verification.

To the fullest extent permitted by law, Colorado Hunt Genius LLC disclaims liability for trespassing citations, criminal or civil penalties, property disputes, loss of hunting privileges, or any damages arising from reliance on map data or land ownership information displayed by the Service.

We continually improve and update the Service.

Accordingly, we reserve the right to add, modify, replace, suspend, discontinue, remove, or limit any feature, functionality, dataset, subscription benefit, or portion of the Service at any time, with or without notice.

We do not guarantee that any particular feature or dataset will remain available indefinitely.

We are not liable for any loss resulting from changes to, suspension of, or discontinuation of the Service.

By creating an account or using the Service, you consent to receive electronic communications from Colorado Hunt Genius relating to your account, subscriptions, billing, security, updates, and operation of the Service.

These communications may be delivered by email or through the Service itself.

You agree that such electronic communications satisfy any legal requirement that communications be provided in writing.

You may opt out of future marketing emails if we offer them; however, you may not opt out of transactional or account-related communications that are necessary to provide the Service.

The Service is intended solely as an informational planning and research tool.

Nothing contained within the Service constitutes legal, regulatory, wildlife management, financial, tax, professional, or other expert advice.

All hunting, licensing, travel, and regulatory decisions remain solely your responsibility.

You agree that you will not:

• scrape, crawl, harvest, or systematically collect data from the Service;
• use automated bots, spiders, scripts, or similar technologies to access the Service;
• reverse engineer, decompile, or attempt to discover the source code of the Service;
• reproduce, download, export, print, copy, mirror, archive, record, or redistribute substantial portions of the Service or its content;
• create bulk screenshots, recordings, or reproductions of premium content;
• bypass subscription restrictions or access controls;
• share premium content with non-Pro users;
• permit unauthorized users to access your account;
• use the Service for commercial purposes without our prior written permission;
• interfere with or disrupt the security or operation of the Service;
• attempt unauthorized access to our systems or infrastructure;
• use the Service to create, support, improve, market, or operate any competing product or service;
• use the Service or its content to train, fine-tune, benchmark, evaluate, or develop any artificial intelligence, machine learning model, large language model, or automated decision-making system without our prior written consent.

No public API is provided unless expressly authorized in writing by Colorado Hunt Genius LLC.

Violation of this section may result in immediate suspension or termination of your account, in addition to any other remedies available under applicable law.

The Service and all associated intellectual property are owned by Colorado Hunt Genius LLC or its licensors.

This includes, but is not limited to:

• software;
• source code;
• databases;
• data compilations;
• proprietary datasets;
• analytics;
• calculations;
• filtering systems;
• hunt rankings;
• terrain metrics;
• maps;
• graphics;
• visualizations;
• written content;
• trademarks;
• logos;
• designs;
• user interface elements; and
• all other original content.

Nothing in these Terms transfers ownership of any intellectual property to you.

Subject to your compliance with these Terms, you are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Service solely for your personal, non-commercial use.

User Content

You retain ownership of the information you choose to save within your account, including your saved preference points and favorite hunt codes.

By storing such information within the Service, you grant Colorado Hunt Genius LLC a limited license to store, process, display, and use that information solely for the purpose of providing the Service to you.

Certain features of the Service rely upon third-party providers, including but not limited to:

• Stripe
• Supabase
• Resend
• Brevo
• Netlify
• OpenFreeMap
• MapLibre GL

These services operate independently of Colorado Hunt Genius.

To the extent permitted by law, we are not liable for interruptions, outages, inaccuracies, delays, or failures caused by third-party providers beyond our reasonable control.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE."

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, COLORADO HUNT GENIUS LLC DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, COMPLETENESS, OR RELIABILITY.

WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF DEFECTS.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, COLORADO HUNT GENIUS LLC, ITS OWNERS, MEMBERS, EMPLOYEES, CONTRACTORS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES.

THIS INCLUDES, BUT IS NOT LIMITED TO, DAMAGES ARISING FROM:

• unsuccessful draw applications;
• incorrect hunting decisions;
• inaccurate or outdated information;
• missed application deadlines;
• purchase of incorrect licenses;
• missed hunting opportunities;
• trespassing citations;
• travel expenses;
• equipment purchases;
• lost profits;
• lost data;
• interruption of business;
• reliance on information provided through the Service.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY ARISING FROM ANY CLAIM SHALL NOT EXCEED THE TOTAL AMOUNT YOU PAID TO COLORADO HUNT GENIUS LLC DURING THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

You agree to defend, indemnify, and hold harmless Colorado Hunt Genius LLC and its owners, officers, members, employees, contractors, affiliates, successors, and assigns from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to:

• your use of the Service;
• your violation of these Terms;
• your violation of applicable law; or
• your infringement of the rights of any third party.

You may delete your account at any time through the Service or by contacting us.

Deletion of your account may permanently remove your saved preference points, favorite hunt codes, account history, and other account-related information. Deleted information may not be recoverable.

We may retain certain information after account deletion as required by law or for legitimate business purposes, including fraud prevention, tax, accounting, dispute resolution, security, and enforcement of these Terms.

We reserve the right to suspend or terminate accounts that violate these Terms or misuse the Service, including accounts we reasonably believe belong to an individual under 18 years of age.

The provisions relating to Intellectual Property, Acceptable Use, Disclaimer of Warranties, Limitation of Liability, Indemnification, Governing Law, and any other provisions that by their nature should survive termination shall remain in effect after termination.

We may update these Terms from time to time.

When material changes are made, we will post the updated Terms with a revised Effective Date.

Your continued use of the Service after the revised Terms become effective constitutes your acceptance of the updated Terms.

These Terms shall be governed by and interpreted under the laws of the State of Colorado, without regard to its conflict of law principles.

Any legal action arising out of or relating to these Terms or the Service shall be brought exclusively in the state or federal courts located within the State of Colorado, and you consent to the personal jurisdiction of those courts.

Preference for Individual Resolution

We do not require arbitration. However, we strongly prefer, and you agree, that any dispute, claim, or controversy arising out of or relating to these Terms or the Service be pursued only on an individual basis, and not as part of any class, consolidated, mass, or representative action, and not as a private attorney general on behalf of others, to the fullest extent permitted by applicable law.

You and Colorado Hunt Genius LLC each agree to waive any right to participate in such a class, consolidated, mass, representative, or private attorney general action against the other. Both parties acknowledge that a court may, in certain circumstances, decline to enforce this waiver in whole or in part. If a court declines to enforce this waiver as to a particular claim, that claim may proceed on a class or representative basis in that court alone, and all other provisions of these Terms — including the remainder of this Section 21 — will remain in full force and effect.
